ART LICENSING FAQ
What is art licensing?
Art licensing allows a business to legally use an artist’s artwork or patterns on approved products, packaging, marketing materials or other commercial applications.
Rather than purchasing the copyright or owning the artwork outright, you are granted permission to use the design under an agreed licence.
How does art licensing work?
Once you have selected an artwork or pattern, we will discuss how you would like to use it, including the product category, territory, licence term and whether exclusivity is required.
A customised quote and licensing agreement will then be prepared based on your specific requirements.
Once the agreement is approved and payment is received, the licensed artwork files will be supplied for the agreed use.
Do I own the artwork after licensing it?
No. Copyright and ownership of the original artwork remain with Carolyn Quan Art.
The licence gives you permission to use the artwork only as outlined in your agreement.
Any use outside the agreed terms will require additional written approval.
What does exclusive licensing mean?
An exclusive licence means the artwork or pattern is reserved for your business within the agreed product category, territory and licence term.
For example, you may receive exclusive rights to use a design on home décor products in Australia for two years. This does not necessarily mean you own the artwork or have exclusive rights across all products and countries.
What does non-exclusive licensing mean?
A non-exclusive licence allows you to use the artwork or pattern while Carolyn Quan Art retains the right to license the same design to other businesses.
Non-exclusive licensing is often a flexible and cost-effective option for brands that do not require exclusive access to a design.
How long does an art licence last?
Licences are granted for a specific period of time, known as the licence term. The length of the term is agreed before the licence begins and will be included in your licensing agreement.
At the end of the term, you may have the option to renew the licence, subject to availability and a new agreement.
